Playnasium urge you to read the following terms and conditions fully, as by using this website (whether or not you place an order) or by purchasing from us by any other means you are agreeing to be bound by them. Please do not use this website or purchase from us by any other means if you do not agree to be bound by them. The terms and conditions that apply will be those displayed on this website at the time of use, so we also urge you to check these terms and conditions at the time of use, as we reserve the right to modify them whenever we feel it necessary. If any part of these terms and conditions is deemed by a court of law not to be binding, the remaining terms and conditions shall continue to apply.

Statutory Rights
Nothing in these terms and conditions excludes or limits your statutory rights in any way, including your statutory rights in relation to faulty or misdescribed goods, details of which can be obtained from Consumer Direct (the Government's consumer advice helpline) or your local Trading Standards Office.


Minimum Age
Please note that this website is not intended for use by children, and you must be over 18 years of age to place an order.


Prices
All prices are in UK pounds. Where VAT is applicable, it is included in the prices displayed. Prices on this website are subject to change without notice and may differ from prices in our showroom. We will do our best to ensure the accuracy of the prices displayed on our website, but if the price of an item you have ordered is incorrect, we aim to contact you within 48 hours to let you know. In such circumstances, you can cancel the order, in which case a full refund of any money you have paid will be issued. Please note that prices of products to be sent to customers outside of the UK may vary from those displayed, so please contact us for a quote before ordering.


Payment Methods
We can accept payment by the following credit and debit cards: Mastercard, Visa, Visa Debit, Solo and Maestro. You must be the rightful owner of the card used and the card must have been issued in the UK. Online card transactions are processed through WorldPay (part of The Royal Bank of Scotland Group), who use "a combination of both established and innovative techniques to ensure the security and integrity of all sensitive data." Any communication between the shopper and WorldPay is encrypted to the maximum strength supported by the shopper's browser using 128 Bit SSL. Depending on the card you are using, a 'Verified by Visa' or 'MasterCard SecureCode' pop-up screen may appear at the WorldPay payment stage, offering an additional security feature requiring use of a password.

When a shopper makes a card purchase via WorldPay, the transaction is set to a 'pre-authorised' status. Although funds are reserved against the shopper's card, the money is not debited at this point. Pre-authorisation allows us 5 working days to 'capture' the transaction. If for any reason we are unable to fulfil an order, we will cancel the transaction - the shopper's card will not be debited and the funds will cease to be reserved against the shopper's card.

For orders placed online via an auction website, we can accept payment via PayPal, who state: ''PayPal automatically encrypts your confidential information in transit from your computer to ours using the Secure Sockets Layer protocol (SSL) with an encryption key length of 128-bits (the highest level commercially available).''

We can also accept payment by postal order or cheque (made out to Playnasium), but if paying by this method please take into account that it will take several days for payment to clear after we have received it and we will not dispatch until the payment has cleared. Any item/s ordered will not be reserved until your postal order or cheque is received. If we realize we are unable to fulfil an order on receipt of a postal order or cheque, we will return the postal order or cheque. If possible, invalid postal orders or cheques will be returned on request and on receipt of return postage charge by the customer. We will not accept (and hereby disclaim) liability for loss of postal orders or cheques by Royal Mail.

Please do not send coins, bank notes or any other form of payment.


Title
Title of the goods will not pass to the customer until Playnasium receives payment in full for the goods. When a customer exercises the right to cancel an order, ownership of the goods will revert to Playnasium.


Availability
If you place an order via this website, shortly afterwards an automated e-mail will be sent to the e-mail address you have provided. This e-mail is solely to confirm that we have received an order from you and is not a guarantee that we will be able to fulfil the order. Once we have checked the details of your order, we will send you another e-mail to confirm availability and acceptance of your order. If we find that we are unable to fulfil your order for any reason (for example, if we have sold out of an item and have not been able to update the website before you placed your order), we will contact you as soon as possible to let you know, and a full refund of any money you have paid will be issued (where relevant).

An exception to the above procedure is for orders placed from outside the UK or where the payment card was issued outside the UK. We do not accept any order placed from outside the UK or any order where the payment card was issued outside the UK and any such transaction will simply be cancelled without further notice (the shopper's card will not be debited).

We reserve the right to choose not to accept any order.

It is your responsibility to make sure the e-mail address you give us is correct and working - once we have sent an e-mail, we will assume that it has been received and read.


Delivery
Standard delivery is £2.99 per order. We also offer an 'Express' delivery option on most items for £5.99.

Our estimated standard delivery time is 3 - 5 working days from the time you place your order, unless a different delivery time is stated below the product description. 'Working days' are classed as Monday to Friday (excluding public holidays and any periods specifically stated on the website), but items sent via Royal Mail may be delivered on a Saturday. We will usually dispatch when your complete order is ready, so if ordering more than one item, and the items have different delivery times, the estimated delivery time will be the longest of those stated. If you pay for express delivery, the estimated delivery time is 1 - 2 working days. Please allow slightly longer than the above delivery times if you live in the more remote parts of Scotland/offshore islands.

Playnasium does not accept orders placed from outside the UK and currently only delivers to addresses within the UK (some items can only be delivered to addresses in England, Wales and parts of Scotland - this is stated below the product description). Orders for delivery to the Channel Islands or Isle of Man can only be placed by phone and items sent to these areas will be at different prices to those advertised. Some products are sent direct from our suppliers.

When the item has been signed for at the specified delivery address, we will not accept responsibility if the item fails to reach you. If the delivery driver is unable to deliver, they will post a card telling you that they have tried to deliver. You will then have to contact the delivery company to arrange another delivery attempt or collect your parcel from the collection office stated on the card. If your parcel is not collected within 7 days, it will be returned to us, after which you will be refunded with the price of the item/s ordered (the delivery charge will not be refunded). At your request, and at our discretion, we may send the item again, but another delivery charge will be incurred by you.

We will inform you immediately if we know delivery is going to be delayed. If you haven't received an item within the relevant delivery time and we haven't informed you about a delay, please email orders@playnasium.com or phone us on 01865 600 567. Due to couriers' time limits for claims for loss, we will not replace or refund an order if we have not been informed of non-delivery within 30 days of notification of dispatch of your order.

If we experience problems with getting a parcel delivered to the customer's address, whether this is the fault of the customer or the delivery company's staff or a combination of both, we reserve the right to cancel the order and refund in full any money that has been paid for that order.

In no circumstances can we accept liability for any losses, inconvenience or any problem of any kind caused by late delivery or non-delivery of any item. Please do not purchase from us if the timing of delivery is critical.


Returns Policy

Please check the delivery carefully as soon as it arrives and inform us straight away if there is anything wrong.

* Incorrect or faulty goods
If we deliver a faulty item to you, or the item is not what you ordered, it can be returned via a delivery service advised by us and you have the choice of a replacement (subject to availability) or a full refund (including delivery charge), providing we are informed in writing of your rejection of the goods within 14 working days from when you receive the goods (return can be arranged after this time) and we have authorised the return. You can inform us by sending an e-mail to returns@playnasium.com. Goods damaged by the customer by accident, neglect or misuse will not be refunded or replaced. If you request a refund, any item supplied free with the product must also be returned. If, in error, we send items in excess quantity or value to what you have ordered, you must return them on request. Failure to do so will result in legal steps being taken to recover the goods from you.

* Unwanted goods
Except where the goods have been made to your specifications or clearly personalised, or you are a trade buyer, or the item concerned is a DVD that you have unsealed, you can cancel your order, without giving a reason, within 14 working days of receipt of goods (beginning on the day after the day on which you receive the goods). To exercise this right to cancel, send us a written notice of cancellation by e-mailing returns@playnasium.com within the 14-day period. A refund of the amount you paid for the goods will be issued within 30 days of cancellation. You must arrange and pay for the return of the goods to us. Each returned product must be complete and in an unused condition. Any item supplied free with the product must also be returned. If you would like to return an item after this 14-day period, this is entirely at Playnasium's discretion and, if agreed, will be subject to a re-stocking fee advised at the time.

Please make sure that your return is securely packaged and send it to the address we give you. We will not accept responsibility if the package does not arrive, so we recommend that you obtain proof of posting and a suitable level of insurance from the delivery company.


Warranties
Individual products for sale on Playnasium may be covered by the relevant manufacturer's warranty. Such warranties are not enforceable against Playnasium.


Disclaimer
We will make every effort to describe products and their usage accurately, but slight variations may occur in the actual goods. For example, unless you tell us that the colour or pattern in the product description or photo is critical, we may substitute for the nearest available colour or pattern. You are, of course, free to return such goods within the time limits stated in the Returns Policy above.

We cannot accept (and hereby disclaim) liability:
a) for losses that were not reasonably foreseeable by Playnasium when the contract was made;
b) for losses that were not caused by any breach on the part of Playnasium;
c) for any indirect or consequential losses, including but not limited to business losses;
d) for losses to non-consumers, howsoever caused.

Without limiting a) to d) above, the total liability of Playnasium (howsoever arising) will not exceed the amount paid by you to us for the goods purchased.

Every product is sold on the understanding that it will, at all times, be used only as directed in the instructions provided by the manufacturer and only in the fashion that it is intended for. Any unorthodox or reckless use of a product may be dangerous. Common sense should be applied at all times. If necessary, check with a doctor or other relevant specialist that it is safe for the intended user to use a certain product.

Law
These terms and conditions shall be governed by and construed in accordance with English law.
